In the grand scheme of things, if Ford deems a failure was due to a tune and denies warranty, it seems to me that it would not matter who or when the tune was installed, just that it was done.
If you unknowingly bought a car with no air filter element and the engine blew up and Ford tracked it back to lack of filter, they're not going to give you a pass because you're a new owner and just didn't know - a modification (or improper maintenance) was done that resulted in failure.
Perhaps legally, Ford would have to prove that the tune caused the failure, but their pockets are pretty deep if they deny your warranty service and you decide you want to fight it.
EDIT: Not sure how this works with aftermarket warranties.
