Title: Gasket covering air intake inlet?

My brother-in law noticed this...has anyone noticed how the black gasket under the hood completely covers the air intake slot?

On my '13 it does not occlude the intake as the seal is on the front plastic fascia and the air is drawn from below this. Also on the dyno with hood up there is no difference in performance of my SHO with the OEM intake connected vs w/o the entire OEM intake and filter hooked to the saxophone (just laid to the side disconnected).
